How can Legal Aid WA help?
Legal Aid WA does not draft wills, or give advice or assistance about probate or letters of administration, or coronial matters. Lawyers working in our Elder Rights WA service can give those eligible free advice about making a will but they cannot draft your will for you.
Grants of aid in civil matters are normally not available for help with wills and estates.

Call the Infoline or contact your nearest Legal Aid WA office or email ElderRights@legalaid.wa.gov.au to find out what help we can give for your situation. If we can’t help, we may be able to refer you to someone else who can.

Where else can I get help?
- Citizens Advice Bureau can give advice about making a will and may be able to draft your will for you. Fees may apply. You should ask about their costs before you speak with a lawyer. They also give advice on probate and letters of administration. Call (08) 9221 5711 or email: queries@cabwa.com.au
- Peel Community Legal Services offer a simple will service for people living in the Peel Region. For a low fee, a lawyer will help you understand the requirements of a simple will and then draft your will for you. Eligibility criteria apply. Call: (08) 9581 4511.
- The Public Trustee WA drafts wills for a fee. You can also store your will in the WA Will Bank. The Public Trustee will only draft a will that:
- nominates the Public Trustee as your one and only executor; or
- nominates your spouse (or de facto partner) as your executor and the Public Trustee as your substitute executor.

- The Law Society of WA has a Find a Lawyer tool on its website to help you find a private lawyer who works in wills. We recommend that you obtain an estimate of costs before you get help from a private lawyer.
- Aboriginal Mediation Service on (08) 9264 6176 or 1800 045 577 offers dispute resolution services to Aboriginal and Torres Strait Islander people, including funeral and burial disputes.

- Coroner's Court of WA on (08) 9425 2900 or 1800 671 994 for information on the Coronial Counselling Service, the role of the Coroner, organ donation (under Practical Issues) and autopsies.
