The Assessing section of Client Services Division performs a crucial role within Legal Aid WA with its main function being to assess applications for legal assistance to determine grants of aid. This process needs to keep in mind the limited resources available, competing interests and established priority and eligibility guidelines. Assessing takes into account three essential factors in the assignment of applications:
- the relevant State or Commonwealth guidelines designed to prioritise types of matters funded;
- the financial eligibility of the applicant (measured in accordance with the National Means Test); and
- the merit or prospect of success of the applicant's case.
